Only then would I consider going to sleep with a fire in my home. If you don’t have a fireplace screen, then try spraying your fire with water until the last ember has died.

If you fill a spray bottle with water, you don’t have to pour gross amounts water on the fire and possibly damage a rug or make a mess. The water bottle will douse the fire with an appropriate amount of water and you’ll be able to rest at night knowing that your home is safe.

Of course, the safest fireplace experience is the gel fuel fireplace that doesn’t throw a spark and can be put out with the simple drop of a lid. If the gel fuel fireplace had been used, the Dobosz would not have had to endure damage to their home and feel the guilt for putting a law enforcement officer in danger.

So, always be safe when it comes to fire. Your friends deserve to know that your home environment is safe when they visit and your family absolutely requires it. Make sure all fires are out before you go to sleep and you’ll never have to worry about waking up to fire hazards.

One of the many responses to the ever-evolving challenges facing occupational safety and health professionals over the past decades is the theory of Behavior Based Safety (BBS). Unlike traditional safety systems that focus on management, engineers, and safety professionals as responsible owners of safety within an organization, BBS shifts that focus of responsibility to an organization's workforce. In other words, BBS theorizes that frequencies of illness and injury can be decreased through modification of worker behaviors (Boyce & Roman, 2002), and that such modification be accomplished by focusing management attention on unsafe acts committed by workers. However, despite widespread implementation of Behavior Based Safety initiatives over the past two decades, a safety system based on the common culture of BBS is one based on inherent flaws that predispose the organization to failure in terms of safety.

Sweeping Acceptance

Safety consultants in the United States were well positioned to fill a void created by a sharp decrease in the number of new OSHA edicts in the mid-1990s, and many of them proposed Behavior Based Safety to their clients, who themselves were well positioned for such contracts due to the favorable economic condition of the decade (What Happened, 2002). The influx of BBS initiatives throughout the country created a wave of acceptance due to the fact that so many organizations were embracing the theory. So much so, in fact, that U.S. health and safety agencies not only seemed to turn a blind eye, but also provided support in many cases (Frederick & Lessin, 2000). For instance, there is evidence to suggest that at one point OSHA may have been requiring BBS as a Voluntary Protection Program criterion, and that NIOSH was also involved in expanding the wave of BBS acceptance and implementation (Frederick & Lessin, 2000). In a November 2000 Multinational Monitor article, James Frederick and Nancy Lessin stated that “NIOSH has awarded research grants, studying the impacts of Behavior Based Safety, to the very consultants who market and sell the BBS programs” (Frederick & Lessin, 2000, p.7).

Widespread Reality

For all of the approval BBS garnered in the 1990s, much of which still exists today, a 2002 poll conducted of American Society of Safety Engineer (ASSE) chapter presidents revealed that, in their opinion, BBS will decline in practice due to a lack of proof for its effectiveness (What Happened, 2002).

Understanding why Behavior Based Safety fails requires closer inspection of its inherent flaws.

Although safety systems involving BBS vary from one organization to another, at the core of each is the theory that unsafe acts committed by workers are the primary causes of accidents and injuries (Topf, 2002). The result of such a safety perspective leads to a responsibility shift away from foremen and supervisors (Questions, 2002), as well as an atmosphere of fear in an organization where workers are reluctant to report incidents for fear of labeling and punishment (Frederick & Lessin, 2000). The following example illustrates the atmosphere of fear reality:

“At one factory that had implemented a behavioral safety program, the United Auto Workers Health and Safety Department reports, when a union representative asked workers during shift meetings to raise their hands if they were afraid to report injuries, about half of 150 workers raised their hands. Worried that some workers feared even raising their hand in response to the question, the union representative asked a subsequent group to write “yes” on a piece of paper if they were afraid to report injuries. Seventy percent indicated they were afraid to report injuries. Asked why they would not report injuries, workers said, “we know that we will face an inquisition,” “we would be humiliated” and “we might be blamed for the injury” (Frederick & Lessin, 2000, p.3).

To further highlight how significant the flaws of BBS truly are, one need not look further than the core of all BBS programs, which, as stated above, is based on the presumption that unsafe acts committed by workers are the primary causes of incidents. To be more specific, BBS proponents typically assert that such unsafe acts are responsible for approximately 85% of all incidents (Frederick & Lessin, 2000). However, these presumptions are based on 1930s research conducted by insurance investigator H.W. Heimrich, which consisted of accident report reviews (Frederick & Lessin, 2000). Because the accident reports Heimrich reviewed were creations of management, it is not difficult to understand why workers were found to be at fault 85% of the time. Moreover, by his own admission in June of 2000 at a conference held by the ASSE, noted safety consultant and BBS advocate Dr. Thomas R. Krause stated that “the situation in which the injury is actually caused by the worker, while existent, is extremely rare” (Manuele, 2000, p.3).

In addition to the comments made by Dr. Krause that refute the very tenet on which BBS was designed so many years ago, Fred A. Manuele suggests that other BBS experts “1.) Promote the principle offered by W. Edwards Deming that performance does not come from the individual… but the system, and 2.) Recognize that the principle focus for safety improvement should not be on the psychology of correcting worker behavior; rather, the focus should be on the design of the workplace, the work methods, and the management system” (Manuele, 2000, p.1).

Conclusion

The wave of Behavior Based Safety created by consultants in the 1990s crested amid high industry optimism and consultant profits, and is now crashing amid a lack of proof for its effectiveness. As current programs continue to divide workers and management, consultants are scrambling to redefine BBS in terms of concepts that provide understanding, partnership, and success (What Happened, 2002). Whether such reinventions of the theory will ever be realized remains to be seen, but current approaches of BBS are best described by Frederick and Nancy Lessin:

“The blame-the-worker approach of behavior-based safety programs is incompatible with, and designed to represent an alternative to, efforts — including those mandated by law — to identify and eliminate or reduce the hazards responsible for the epidemic of worker injuries, illness and death” ((Frederick & Lessin, 2000, p.8).

A health and safety representative is an employee appointed to represent workers in matters related to their continued occupational health and their reasonable safety in the workplace in addition to the normal work activities. This person will liaise with the employer in order to address any occupational health related issues and safety concerns of the workers.

These representatives play a pivotal role in keeping workplaces healthy and safe. By representing workers in their area of responsibility, these representatives provide a means for workers to raise issues affecting their health as well as safety issues within their workplace, and follow a process with managers to resolve them.

Most newly appointed workplace representative will probably initially be unsure what to do as an appointed representative. The representative is not expected to be the person responsible for all health and safety matters in the workplace, nor is he expected to be an expert on these issues. A workplace representative purely represents the workers in their area of responsibility in the partnership between employers and managers on issues relating to occupational health issues and matters associated with the safety in the assigned work area.

In order to do this effectively a number of roles and responsibilities have traditionally been assigned to this role. An understanding of these basic functions of the representatives will make it a bit easier to put the election and appointment process in perspective. The primary function is certainly to represent the health and safety interests of employees at the workplace. Secondly it is to encourage safe and healthy work practices and thirdly it is to advise the employer of any safety or health hazard that comes to the notice of the representative. It is therefore important to ensure that the correct procedure is followed in identifying the appropriate persons to be appointed in these roles.

Guidelines for the Process

The elected representatives will represent employees at employers meetings and other forums on issues pertaining to health and safety at the workplace. In these cases the representatives are elected according to a procedure agreed upon by the employees and employer. Upon election they are then informed of their appointment to serve at that capacity provided they agree to take up the challenge.

One of the first steps in arranging the electing of workplace representative is the selection and appointment of an independent election officer to manage the election. It is a good practice to ensure that such election officer or team is recognized as an independent party by the members of the work group for whom the election is being arranged.

It is definitely a rule that a person being appointed as an election officer cannot be a candidate for a health and safety representative position in the same election.

In some countries legislation requires that certain procedures be followed when electing health & safety representatives. In terms of these laws the employer is normally required to circulate a memorandum to all staff informing them about the elections of these representatives that is about to take place. In these cases the employees at a place of work are entitled to nominate and elect one of their members to act as a representative in their area.

It may be better to appoint more than one workplace representatives to each area in the workplace, depending on the extent and risk profile of the workplace. The success of the representative system is vested in the principle that each representative is being elected to represent a particular work group of employees. To be effective a representative will need to have regular and easy contact with members of the work group being represented. For this reason it is desirable to elect a representative from the team rather than from another team or area.

In order to avoid a conflict of interest it is strongly recommended to exclude any personnel who are employed as managers or supervisors from being considered as potential health and safety representatives. This means that only non-managerial employees should be allowed to be nominated as candidates.

The general rule is that any recognized members of a work group can nominate or be nominated for the position of a workplace representative. It is also a good practice to get nominations in writing as this will enhance the transparency of the process. There should be no limitation on who may nominate candidates and this includes that candidates may nominate themselves or may be nominated by other members of the team. Under normal circumstances there is no need to have nominations seconded as long as they are in writing. The rule is that nominations should be received by the election officer at least three working days before the ballot is to take place in order to ensure sufficient time is available to prepare all ballots and election material.

Appointing the Workplace Representatives

Irrespective of whether the workplace representative is elected or selected, the successful candidates are appointed as health and safety representatives and then required to undergo an appropriate course for this type of representatives. Their term of office can be determined by the management of the organization or by legislation, but is normally no less than1 year.

It is desirable to not only appoint a representative for each area but to also appoint an alternate for each representative. In the event of a resignation or transfer from the designated area or a post becomes vacant for a short period as a result of a temporary absence of the appointed representative the alternate will normally step up and fulfill this role until the situation returns to normal. In the event of a permanent vacancy the process will start afresh.

The elected representative is normally issued with a letter of appointment to allow him to act in accordance with his appointment.

Although it is not a requirement of most laws dictating the processes and procedures of electing health and safety representatives, it is good practice to inform the affected unions of the outcome of the elections. If the elected representatives are union members it is normal for them to contact their union as soon as possible after the results of the ballot are known. This enables unions to ensure that representatives receive any union training developed for these positions and to provide representatives with information to assist them to represent members of their working place effectively.

Working as a freelance contractor, predominantly those in IT, you should already know about the IR35 rules and regulations. The IR35 concerns any contractor who isn’t seen as self employed according to the Inland Revenue’s classification.

Becoming law through Schedule 12 of the Finance Act 2000, the IR35 rules were prompted to stop freelance contractors from claiming they were self-employed and setting up a limited company. This way they could pay themselves a minimum amount for their salary and get the rest in large dividends. The rules ensure that contractors now come under the same taxation laws as anyone doing similar work under a standard PAYE situation.

The primary motives behind the IR35 rules were to thwart those working in the IT industry, it was common practice for them to resign from their permanent job and, after a few weeks, go back to the same job but this time working as a contractor with their own limited company. They did this because the money was a great deal higher due to a lower tax band and less national insurance as a proportion of their income to pay.

Finding out if you are classed as employed or self-employed is dependant on the Inland Revenue; the IR35 rules apply to those who are not termed as self-employed.

If your job entails you working in a particular location, such as an office, on a regular weekly routine and you are using all your employees tools at the site, then the Inland Revenue would regard you as being employed by that company, this means you come under the IR35 rules.

Alternatively, if you work on a daily basis at home, have a quantity of singular customers and utilize your personal equipment for work, then you come into the self employed category. The Inland Revenue looks at each individual case and the surrounding conditions concerning your working situation and concludes your employment class from their results. The more pointers there are to genuine self employment the better for you as this way you evade IR35.

A standard limited company contractor who doesn’t come under the IR35 rules, would generally pay himself a salary (net of employers and employees’ national insurance contributions, and income tax), with the lion’s share of income paid in dividends. Those who do have the IR35 rules applied to them for a particular contract will find their earnings are notably lower than if they were classed as self-employed.

Every time you consider accepting a new IT contract as a contractor, ensure that the conditions of the contract openly show that they follow the IR35 rules, this would mean that they clearly state you are not an employee of the company you will be undertaking the work for. These conditions also apply to the way you do your job, such as where you work and whose tools of the trade you are using.

The IR35 rules apply to each individual contract that you accept, the Inland Revenue does not look at you as a contractor. This could mean you have 4 to 5 separate contracts over the course of a year, but each one will be viewed individually, so some may be classed under the rules, whereas others may not.

Talk to any number of contractors and it becomes obvious that not everyone is familiar with the IR35 rules and regulations. Or have just done nothing about the change in law as they feel the rule will be changed again soon or believe it doesn’t affect them. Nevertheless, the IR35 is now the law and it is your duty as a contractor to confirm if you fall within their rules or not, if you do you need to adjust your tax payments accordingly.

With the increasing amount of portable IT equipment and other teaching aids used in schools these days, it is important that all a school’s assets are kept track of. Tracking equipment means that when a member of staff or pupil wants to use something, it can be found easily and time is not wasted.

School equipment challenges

Keeping track of equipment in schools can be challenging. With so many staff needing to use various pieces of equipment at different times, it can understandably be difficult for the designated co-ordinator to monitor everything.
